or revenue, in any other mode than that prescribed in this section, he
shall forfeit the arrear for which the distress may be levied to the defaulter,
and make good to him the value of the property sold or disposed of, with
all costs of suit.
VI. Section XXVI. Regulation XVII. 1793, regardingthe payment of
the purchase-money of distrained property, is hereby rescinded, and the
rule contained in the following section is enacted in lieu of it.
VII. The property shall be paid for in ready money at the time of the
sale, and the purchaser shall not be permitted to carry away any part of
the property which shall not have been paid for. Should the purchaser
fail in the payment of the whole or part of the purchase-money within
five days, calculating from the day following the sale, the whole of the
property, or the part of it which may be unpaid for, shall be resold by the
C2722^2/, on such day as he shall hx, for the best price that may be ottered
for it. The defaulting purchaser shall forfeit to the distrainer ten per
cent, on the amount of the price at which he shall have purchased the
property so resold, and make good to him any loss that may arise, as w^ell
as the expenses that may be incurred on the resale. If any proht shall
accrue on the resale, it shall be carried to the credit of the defaulter.
