rules prescribed by this Regulation; and whereas the lands of persons
paying revenue to Government, as well as the lands of persons holding
lands exempt from the payment of revenue, are also liable to be sold in
satisfaction of decrees of the courts of justice ; and whereas it is necessary
that rules should be prescribed for the sale of lands in the cases above
stated; and whereas it is essential to the security of the public revenue
due from lands paying revenue to Government, that the jumma of such
lands, whether sold on account of arrears of revenue to Government or
in satisfaction of decrees of the courts of justice, should be adjusted
conformably to the principles prescribed in Section XXXVII. Regula-
tion XXV. 1803; and whereas it is expedient, that rules should be esta-
blished for enabling the officers of Government to apportion the jumma of
lands assessed with public revenue which may be sold for the purposes
above specified, and for empowering the Board of Revenue, the collectors
of the revenue, and the courts of justice, to countermand or postpone the
sale of lands, in the event of the arrears of revenue demandable from the
defaulter, or of the amount of the decree, being discharged previously to
the sale being made, or for other sufficient cause ; and whereas it is essen-
tial, in dividing landed property paying revenue to Government into two
or more distinct estates, that the share or shares comprised in each estate
should be rendered as compact as circumstances may admit, in order to
obviate disputes, equally prejudicial to the interests of the proprietors and of
Government, regarding boundaries, water, and other matters, which neces-
sarily result where the lands belonging to different estates circumscribe
each other or are intermixed; and whereas, in such cases, justice to the
sharers, and the security of the resources of the state, require that the
public revenue should be apportioned on each of the estates into which
the property may be divided, agreeably to the rules prescribed in Regula-
tion XXV. 1803 ; and whereas it is also necessary, for the convenience of
the proprietors of two or more estates which may have originally formed
specific and ascertained proportions of the same zemindary, talook, or
other tenure, and for preventing the divisions of landed property becoming
too numerous and minute, that the proprietors of such estates should
be allowed to unite them into one estate: the following rules, applicable
to the several cases above specified, are accordingly enacted.
