I. WHEREAS the distance from the presidency of the districts comprised
in the Western Provinces, and the difference of their climate from that of
Bengal, are so great as to deter individuals from personally resorting to
the highest appellate authority, to obtain redress against any acts or orders
of the subordinate Courts ; and whereas, owing to the same cause, the
suitors in those provinces are subjected to serious expense, difficulties, and
delays in procuring fit individuals as their representatives for the prosecu-
tion or defence of appeals preferred to the Sudder Dewanny Adawlut; and
whereas the final disposal of important criminal trials would be much
expedited, and the control over the several judicial and magisterial autho-
rities in the districts in question rendered more efficient by the appoint-
ment of a separate Court of Sudder Dewanny and Nizamut Adawlut for
the Western Provinces, including the province of Kumaoon; and whereas
embarrassment has been experienced from the want of a suitable tribunal
for the trial of prisoners charged with offences of a heinous nature com-
mitted within the Saugor and Nerbudda territories, and it has therefore
been deemed expedient to provide for the due and deliberate investigation
of charges of that nature, the following rules are enacted, to be in force
from the 1st of January, 1832, throughout the provinces immediately sub-
ject to the presidency of Fort William.
II. From and after the date of the promulgation of this Regulation,
such parts of Regulations X. and XVI. 1795, of Regulations V. and VIII.
1803, and VIII. of 1805, or any other Regulation in force, as extend the
powers of the Sudder Dewanny and Nizamut Adawlut stationed at Cal-
cutta to the province of Benares and the Ceded and Conquered Provinces,
are hereby rescinded.
III. #77w/. A Court of Sudder Dewanny and Nizamut Adawlut shall
be constituted for the Western Provinces, to be ordinarily stationed at
it is now at X//7iA7iZ<777/, and to exercise jurisdiction over the whole of the districts
comprised within the divisions numbered in Section II. Regulation 1.
1829, as No. 1 to 9 inclusive ; and a Court of Nizamut Adawlut for the
province of Kumaoon, and the Saugor and Nerbudda territories.

Reg. VI. 1831.
