XLII. An appeal shall lie to the High Court from the deci-

Court- whether a Chief Matrimonial Court or a

District Matrimonial Court, on the ground of the decision being
contrary to some law, or usage having the force of law, or of a
substantial error or defect in the procedure or investigation of
the case which may have produced error or defect in the decision
of the case upon the merits, and on no other ground : Provided
that such appeal be instituted within three calendar months after
the decision appealed from shall have been pronounced.

XLIII. When the time hereby limited for appealing against
Liberty to parties any decree dissolving a marriage shall have
to marry again. expired and no appeal shall have been presented
against such decree, or when any such appeal shall have been
dismissed, or when in the result of any appeal any marriage shall
be declared to be dissolved, but not sooner, it shall be lawful for
the respective parties thereto to marry again, as if the prior
marriage had been dissolved by death.

V.—Of the Children of the Parties.

XLIV. In any suit under this Act for obtaining a judicial
Custody oi child- separation or a decree of nullity of marriage,
ren pendente lite. 01. for dissolving a marriage, the Court may
from time to time pass such interim orders and make such pro-
vision in the final decree as it may deem just and proper, with
respect to tire custody, maintenance, and education of the children
under the age of sixteen years, the marriage of whose parents is
the subject of such suit, and may, after the final decree, upon
