XXXVI. The Go22r/ 0/ GX'c/zX is required by Section XXVII. to
transmit to the Nizamut Adawlut copies of their proceedings on the trial
of all prisoners whom they may sentence to sutler death, or who may, in
their opinion, be deserving of capital punishment, within ten days after
the trial shall have been completed, or as much earlier as from the state of
business shall be practicable. The court is further directed in the trans-
mission of trials to the Nizamut Adawlut, to give a preference, as far as
shall be practicable, to those trials on which the prisoner or prisoners shall
have been sentenced to capital punishment, or shall be liable to suffer
such under the Regulations.

7722*7 Nothing contained in this section shall be construed so as to
prohibit the restitution to the lawful owners of stolen property recovered
and produced before the magistrates and C22227*/ q/ GHczzz/; nor to restrict
the Criminal Courts from adjudging a reimbursement of costs actually
incurred, upon a prosecution before them, by either of the parties thereto,
in particular instances, wherein they shall consider such reimbursement
just and equitable.

XLII. Nothing contained in this Regulation shall be construed to
empower the G27227*/ 27/ GXC222/ to take cognizance of crimes or offences
committed previous to the 10th day of November, 1801, the date of the
cession of the provinces aforesaid to the Honourable the English East-
India Company ; and all crimes and otfences committed subsequent to the
said date, and antecedent to the date of the promulgation of this Regula-
tion, shall be tried by the laws and Regulations which were in force
during that period.
